The Bombay High Court on Monday said people have the right to hold peaceful protests but cannot cause inconvenience to others. The court made the observation while hearing a petition alleging illegal detention and police brutality during demonstrations in Mumbai against Chief Election Commissioner Gyanesh Kumar.
A bench of Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna directed the Maharashtra government to respond to the allegations. The matter concerns protests held in solidarity with demonstrations in Delhi and will be heard again on November 19.
Court Says Protesters' Credentials Must Be ExaminedThe bench said it could not pass a blanket order against the alleged police action without examining the credentials of those who participated in the protests. It also said the court would not allow a law-and-order situation to be created in the name of peaceful demonstrations. The court noted that the police in Maharashtra had exercised restraint.
